These Terms of Service ("Terms") govern your use of the Kammuna mobile application and website (the "Service") operated by Kammuna ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are between 13 and 18, you confirm that you have parental or guardian consent to use the Service.

3. Account Registration

You are responsible for maintaining the confidentiality of your login credentials. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are solely responsible for all activities that occur under your account.

4. User Conduct and Content

You retain ownership of the content you post, including item listings, photos, and profile information. By posting content, you grant Kammuna a non-exclusive, worldwide, royalty-free license to host, store, and display that content solely to operate the Service.

You agree not to:

• List items that are stolen, illegal, dangerous, or that you do not have the right to lend.
• Use the Service to harass, abuse, defraud, or harm others.
• Impersonate another person or entity.
• Post content that is obscene, defamatory, discriminatory, or violates any applicable law.
• Attempt to circumvent the free nature of the borrowing system by charging fees outside the platform.

Kammuna reserves the right to remove any content or terminate accounts that violate these Terms.

5. Lending and Borrowing

Kammuna is a platform that facilitates connections between users for the purpose of lending and borrowing items. Kammuna is not a party to any lending agreement between users.

• Free Service: Borrowing items through the platform is free of charge. Users may not use the Service to solicit payment for loans.
• User Responsibility: All lending and borrowing arrangements are solely between the users involved. You acknowledge that:
  • Items are lent "as is." Kammuna does not inspect items or verify their condition.
  • You assume all risk associated with lending your property to others or borrowing property from others.
  • You are responsible for arranging the handoff of items and for the return of borrowed items in the same condition as received.
• Loss or Damage: Users are expected to treat borrowed items with care. Any loss or damage to an item is a private matter between the lender and borrower. Kammuna does not provide insurance or assume liability for lost, damaged, or stolen items.

6. Friends and Groups

The Service allows you to connect with friends and join groups. Group administrators may set guidelines for participation, and you agree to abide by those guidelines while using group features. Kammuna is not responsible for the actions of group administrators or members.

7. Prohibited Items

The following items may not be listed on Kammuna:

• Firearms, weapons, or explosives.
• Illegal drugs or paraphernalia.
• Perishable goods, food, or beverages.
• Hazardous materials.
• Items that violate any applicable laws or regulations.

Kammuna reserves the right to determine, in its sole discretion, whether an item is prohibited.

8. Termination

We may suspend or terminate your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service. You may delete your account at any time via the app settings.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. KAMMUNA MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KAMMUNA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY LENDING TRANSACTIONS, INCLUDING LOSS OF PROPERTY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO USE THE SERVICE (NOTING THAT THE SERVICE IS PROVIDED FREE OF CHARGE).

11. Indemnification

You agree to indemnify and hold Kammuna and its affiliates harmless from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Modifications to the Service or Terms

We reserve the right to modify or discontinue the Service at any time. We may also revise these Terms from time to time. Continued use of the Service after changes constitute acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by the laws of the jurisdiction where Kammuna operates, without regard to its conflict of law provisions.
